El autor pretende desentrañar a través de la interpretación jurídica el o los sistemas jurídico penal que los legisladores tomaron en consideración para crear y dar vigencia a los Códigos Penal y de Procedimientos penales vigentes en el Estado Libre y Soberano de México, que fueron tomado como ejemplo, para demostrar que la ley no solo se crea de aspectos abstractos sino también de los criterios que han emitido los juristas en su trabajo.

From a perspective focused on Law, but open to other fields, an evaluation of the influence of Cicero’s thought the analysis of his main works is attempted. No doubt, Cicero’s ideas have been crucial in the development of Western Culture, and two thousand years later his theories still remain alive.

There are two traditions of thinking about idealization offering almost opposite views on their functioning and epistemic status. While one tradition views idealizations as epistemic deficiencies, the other one highlights the epistemic benefits of idealization. Both of these, however, identify idealization with misrepresentation. In this article, we instead approach idealization from the artifactual perspective, comparing it to the distortion-to-reality accounts of idealization, and exemplifying it through the case of the Hodgkin and Huxley model of nerve impulse. From the artifactual perspective, (...) the epistemic benefits and deficiencies introduced by idealization frequently come in a package due to the way idealization draws together different resources in model construction. Accordingly, idealization tends to be holistic in that it is not often easily attributable to just some specific parts of the model. Este artículo presenta inicialmente algunas referencias en torno a la noción de progreso moral, las cuales habitualmente apuntan a la idea según la cual este, en efecto, se da gracias a un mejoramiento paulatino en la humanidad. Si bien tal afirmación engloba una generalidad, el problema puede permitirse un espacio de discusión más sólido, reconociendo que el progreso es, además, reflexión desde el punto de vista kantiano y deducción de la historia por parte de Fichte. Con todo ello, se busca (...) aportar contenido al afirmar que, si bien estos autores apelan a escenarios morales y teológicos para evaluar el futuro, en rigor sus intereses son los fortalecimientos del Estado de derecho para el caso fichteano y de las instituciones para Kant, lo cual resulta en una suerte de perfectibilidad humana. The 21st century faces one of the most singular challenges of all times. How to react to the obstacles that follow the cycle of the Anthropocene, with all its disastrous and putrid consequences? There are two possible ways: acceptance of the situation or the critical and prophetic reaction, that lies on the ground of hospitality and dialogue. When ethnocentrism, xenophobia and fundamentalism grow, dialogue and acceptance of the other urge with a special meaning. Dialogue and Hospitality are expressions that interact (...) and complement each other. Facing the current situation that is asking for interconnection, we must broaden the fabrics of this reception, including not only human beings, but opening the scope to a wider dimension of all creation. Humankind is related, is linked to a larger web that weaves the universe. Inhabiting the Earth gains a new meaning, to be part of life itself. (shrink)

Abstract:There is a storied history of Native and Indigenous feminisms on Turtle Island (North America). We are fortunate that many of those stories birthed from an ancestral tradition of storytelling and survivance were captured in the canonical feminist anthology This Bridge Called My Back: Writings of Radical Women of Color. In celebration and commemoration of 40 years since This Bridge was first published we visit with three of the books original Native and Indigenous contributors–Chrystos, Max Wolf Valerio, and Jo (...) class='Hi'>Carrillo–to recount old as well as new stories as they explore what Native and Indigenous feminisms mean to them and their continued work for Indigenous visibility. The conversation provides a unique intergenerational vision for conceptualizing contemporary Native and Indigenous feminisms all the while building upon the legacy and path set forth by amazing Native and Indigenous women trailblazers. In philosophy of science, abstraction tends to be subsumed under representation, often being described as the omission of a target’s features when it is represented. This approach to abstraction sidesteps cognitive aspects of abstraction processes. However, cognitive aspects of abstraction are important in understanding the role of historically grounded epistemic criteria supporting modeling in science. Drawing on recent work on the relation between metaphor and abstraction, we introduce the concept of paths of abstraction, and use historical and contemporary examples to (...) point to their role in guiding the development of relevance criteria which support modeling strategies in science. New mechanical philosophy posits that explanations in the life sciences involve the decomposition of a system into its entities and their respective activities and organization that are responsible for the explanandum phenomenon. This mechanistic account of explanation has proven problematic in its application to mathematical models, leading the mechanists to suggest different ways of aligning abstract models with the mechanist program. Initially, the discussion centered on whether the Hodgkin-Huxley model is explanatory. Network models provided another complication, as they apply to (...) a wide number of materially diverse systems. In this article, we examine the various attempts to integrate abstract models within the mechanist program, also presenting a further challenge: the Heimburg-Jackson model, which was introduced as an alternative to the Hodgkin-Huxley model. We argue that although the notion of abstraction as the omission of irrelevant mechanistic details appears to give a mechanistic solution for accommodating abstract models, this notion does not suit models whose epistemic strategy is not decompositional. As a result, the mechanist has to choose whether to dilute the mechanistic approach nearly beyond recognition or to claim that many, if not most, abstract theoretical models do not deliver mechanistic explanations, or qualify as explanatory at all. This essay discusses the possibility, relevance, and pertinence of a reactivation of philosophy as a way of life today on the basis of Pierre Hadot’s account and recent scholarly approaches to the topic. In the wake of John Sellars, it regards philosophy as a way of life as a metaphilosophical option that can still be applied today. The essay starts by addressing John Cooper’s criticism of philosophy as a way of life in the contemporary philosophical landscape and shows that, against (...) the background of the model defined by Hadot, Cooper’s objections do not apply. It then illustrates the clear expression of the model in contemporary philosophy through the particular case of Nietzsche. It concludes by outlining some of the considerations that, in the wake of Hadot, Sellars, Michael Chase, and others, might persuade researchers, teachers, and academics to embrace philosophy as a way of life in their work and lives. O presente artigo pretende situar a candente questão das teologias índias no tempo atual e o desafio essencial do reconhecimento da alteridade indígena e dos direitos que acompanham essa singularidade. Inicia-se com a reflexão sobre as controvérsias que envolvem o tema das teologias índias no contexto eclesial contemporâneo. A seguir, discute-se o difícil aprendizado que envolve a tomada de consciência dos povos indígenas como “povos distintos”. Nota-se na atual conjuntura da Igreja católica romana um particular embaraço nesse delicado campo, e (...) uma tendência a entender a diversidade religiosa como momento passageiro ou conjuntural. A questão da alteridade ganha uma peculiar atualidade para a teologia cristã, que vem provocada a ampliar o seu campo de compreensão. Tal aprendizado envolve a ampliação do olhar e também o resgate de valores que são fundamentais, e que nem sempre estão presentes no repertório cristão, como o resgate da espiritualidade terrenal desses povos indígenas. A vida espiritual expressa pela teologia índia revela-se “cosmoteândrica”. Nos rituais andinos celebra-se uma grande comunhão que integra a comunidade humana, o meio ambiente e a divindade geradora de vida. Encontra-se uma viva consciência da imanência de Deus e da sacralidade da criação, da transparência de Deus e de sua diafania por toda parte. Essa espiritualidade recupera valores que são essenciais para o ser humano e que estão esquecidos e abafados em nossa sociedade marcada por uma lógica egocêntrica e pela racionalidade do mercado. Palavras-chave: Teologia índia; alteridade; espiritualidade terrenal; espiritualidade cosmoteândrica. ABSTRACT The present article aims to situate the discussion of the Indian theologies nowadays. It also seeks to situate the essential challenge of the recognition of native alterity as well as the rights that go with such peculiarity. This paper first begins by reflecting on controversies that cover the question of the Indian theologies in the current days.. After that, a detailed discussion on the difficulties of general apprenticeship involving consciousness of the native people as “a different people ” is made. Expressive difficulties on the part of the Catholic Church in dealing with diversity as well as its tendency to comprehend diversity as a conjunctural and not a structural subject are currently observed. The discussion on alterity has required full attention on the side of Christian theology, which has broadened understanding on such issue. Apprenticeship concerning the question of alterity involves expansion of vision and also the recovering of those values which have always been present on Christian repertoire. It is important to emphasize here that one of those basic Christian values to be considered are those related to the recovering of terrestrial spirituality of native people. The spiritual life expressed by the Indian theology appears to be "cosmoteandric". In the Andean rituals, celebration and integration of human community, environment and divinity, are always present. A lively consciousness of the immanence of God, as well as awareness of the sacrality of the creation and the transparency of God and of his manifestation in everywhere is often found among Indian people. Such spirituality recovers values considered of strong importance for human being but unfortunately put aside in our society which is undoubtedly marked by an egocentric logic and by the rationality of economy and market. They conclude that the artifactual approach offers a unifying view into idealization in that it is able to recover several basic philosophical insights motivating both the deficiency and epistemic benefit accounts, while being simultaneously detached from the idea of distortion by misrepresentation. También se reflexiona sobre la dimensión humanista de los estudios generales y la razón de ser de la educación universitaria.

This article analyses the rationality of the principle of proportionality as a justificatory method for solving cases involving conflicts of constitutional principles. It addresses the “problem of comparability”: a set of arguments claiming that proportionalists fail to understand what happens when constitutional principles collide. The problem of comparability suggests that balancing cannot be done if some conflicts of constitutional principles are, in reality, cases of noncomparability, incommensurability, incomparability, or vagueness. In this article, I challenge the views of both proportionalists and (...) their skeptics. Against the skeptics, I argue that proportionality can survive the challenge posed by the problem of comparability. Against the proportionalists, I submit that proportionality cannot be understood as a system of tradeoffs between degrees of satisfaction of principles. If comparison among constitutional principles is to be rational, we need a different approach to normativity—one that allows for the possibility of parity. (shrink)

This paper aims to show how Th eodor Conrad’s theory of meaning goes beyond that of Husserl. By drawing on an unedited typescript dating from the 1950s in which the Munich phenomenologist outlines the controversy between Husserl and the so-called Munich-Göttingen group, I interpret the Bezeichnung–Kennzeichung opposition that Conrad introduces in an article from 1910 as a realist position opposing Husserl’s act-phenomenological concept of meaning. This position stands in contrast not only to the phansisch or phänologisch theory of meaning in (...) the Logical Investigations, but also to the new definition of meaning as phänomenologische Bedeutung that Husserl proposes in his 1908 lectures. Conrad advocates a Gegenstandsphänomenologie, for which the main point of a phenomenological theory of meaning is not, like for Husserl, the intentional acts of the subject but rather the qualities of the object to which the meaning refers. El objetivo de la investigación es interpretar el discurso hegemónico (icónico-lingüístico) de los Fundamentalismos Religiosos de Iglesia Católica y grupos ligados a ella, respecto al aborto, junto a las protestas realizadas por movimientos de ciudadanas y ciudadanos por la defensa de los Derechos Sexuales y Reproductivos de las mujeres en países de la Subregión Andina. La metodología utiliza un análisis de discurso. En conclusión: El discurso y penalización del aborto es ideológico, dominación patriarcal que hace adoptar a las mujeres el (...) aborto inseguro como resistencia paralegal, pudiendo enfermar o morir para obtener la libertad sobre su cuerpo, un derecho reproductivo. Questions of identity involve the attempt to determine what exactly makes a person or thing what it is—what makes Tara Tara or what makes Charming Charming? The chapter analyzes Ricoeur's ideas on personal identity to see if they can help us make sense not only of Tara's identity, but also of how SAMCRO and some of its members maintain their identity across time. Ricoeur describes how we weave the two types of identity, sameness and selfhood, together to form a narrative, (...) a story that allows us to understand how we are able to preserve our identities through time. Narrative identity links up a person's character and the anchor of promise keeping, the practice of keeping one's promises. Finally, the chapter talks life history of John Teller, which is delicately intertwined with the fate of every member of SAMCRO. (shrink)

El presente trabajo aborda el concepto de Transmodernidad bajo dos puntos de vista diferentes. Por un lado, la mirada de Rosa María Rodríguez Magda, la cual nos plantea la Transmodernidad como una tríada dialéctica entre Modernidad-Postmodernidad-Transmodernidad, siendo esta última tanto una continuación como una superación de la Postmodernidad. El otro punto de vista corresponde a Enrique Dussel, el cual nos plantea la Transmodernidad como un proyecto utópico que es transversal a la Modernidad/Postmodernidad; está antes de la Modernidad y a la (...) vez la trasciende, siendo una categoría de exterioridad que pretende sacar la voz propia de las culturas no europeo-norteamericanas, para así poder establecer diálogos interculturales simétricos que llevan consigo características de la propia cultura inconmensurables al proyecto moderno europeo. Así enfrentamos ambas concepciones de la Transmodernidad para destacar sus diferencias y contraposiciones. (shrink)

Al mismo tiempo, revierte sobre la comunidad y el territorio donde se ubica. En contextos reconocidos como vulnerables se necesitan agentes educativos vocacionales y con un alto nivel de resiliencia, y con una meta clara: formar a personas plenas que contribuyan con su sentir, ser y (...) hacer al desarrollo de la comunidad en la que habitan. This paper analyzes the objections of Adolf Reinach to Kant’s transcendental apriorism, shedding light on (1) the speculative distance separating their conceptions of philosophy (namely Reinach’s phenomenology and Kant’s transcendental critique), and (2) the consequential misunderstanding which is at the core of Reinach’s confrontation with Kant. In particular, attention is paid to the issue of the transcendental constitution of objectness, i.e. the question of the givenness of an object with respect to certain functions proper to the subject. In order to (...) illustrate how such a concept is completely absent in Reinach, I will compare his position with those of Husserl, in their relations with Kant’s interpretation of Hume’s philosophy. After the global economic collapse triggered by the Great Recession, there has been an increased interest in the potential psychological implications of periods of economic decline. Recent evidence suggests that negative personal experiences linked to the economic crisis may lead to diminished generalized trust (i.e., the belief that most of the people of the society are honest and can be trusted). Adding to the growing literature on the psychological consequences of the economic crisis, we propose that the perceived personal impact (...) of the economic crisis not only would undermine generalized trust but also may lead to increased interpersonal trust (i.e., directed to specific and close people) and depersonalized in-group trust (i.e., directed to individuals who, while strangers, belong to the same group [e.g., social class]). Across three studies (N = 1379), we tested these central hypotheses and ascertained whether the perceived personal impact of the crisis would predict these types of trust (assessed using questionnaire and behavioral measures) independent of individuals’ socioeconomic status. Non-experimental data from Study 1 revealed that a higher perceived personal impact of the crisis is related to lower levels of generalized trust and higher levels of interpersonal trust. These effects were independent of participants’ socioeconomic status. Non-experimental data from Study 2 replicated the findings obtained in Study 1 and also showed a positive association between the perceived personal impact of the crisis and depersonalized in-group trust. This pattern of results emerged even after controlling for socioeconomic status, gender, age, political orientation, religiosity, and unemployment status. In Study 3, using an experimental design, we found that the salience of a possible economic downturn led to decreased generalized trust and increased interpersonal and depersonalized in-group trust—independently of socioeconomic status—compared with the control condition. These results challenge the conventional wisdom that economic crises invariably undermine trust in others. The implications of the present research as well as future research directions are discussed. (shrink)

Es escasa la investigación sobre las competencias necesarias para educar eficazmente en los primeros años de vida, y sobre los factores que influyen en la adquisición de una identidad docente de calidad para trabajar en Educación Infantil (EI). Los resultados de la presente revisión integradora apuntan que (1) el profesorado excelente de EI atiende a la diversidad de su alumnado, (2) las comunidades de práctica contribuyen a la adquisición de una identidad docente excelente, y (3) ciertas deficiencias en los programas (...) de formación docente y determinados factores contextuales obstaculizan un desempeño docente excelente. El objetivo de la investigación es interpretar el discurso de psicólogos/as que ejercen docencia para la carrera de Psicología en una(s) Universidad(es) Estatal, Privada con Aporte y Privadas de la V Región, Chile, desde un enfoque de subjetividad laboral. Se realizan 6 entrevistas en profundidad a Psicólogos/as y análisis de discurso. El capitalismo académico produce un elevado número de docentes con flexibilidad laboral contractual o trabajo no decente, pues no existe: estabilidad laboral, derecho a sindicalización, vacaciones periódicas pagadas, ni protección (...) social. Estas condiciones son invisibilizadas en el debate sobre la calidad de la Educación. En este contexto, la subjetividad laboral del malestar docente se expresa como: agotamiento, estrés e incertidumbre vital que hace más difícil el trabajo de formación de futuros/as psicólogos/as en la V Región y en el país. Este ensayo apunta a demostrar que el concepto de técnica en los poemas homéricos, Ilíada y Odisea, dista mucho de referirse a un atributo exclusivamente intelectual. La tesis aquí desarrollada es que el concepto en Homero apunta a pensar una disposición de orden corporal o intelectual que permite el desenvolvimiento del sujeto en un entorno circunstancial. El desarrollo del escrito es un examen de las formas de aparición del concepto en los poemas homéricos, para aislar su significado fundamental: primero en (...) la Ilíada, luego en la Odisea y finalmente, la relación que este concepto guarda con la noción de saber.
